THE COURT BROUGHT THE EX-HEAD OF THE RUSSIAN "SUBSIDIARY" OF RADIO LIBERTY* TO THE SUBSIDY
A key event in the framework of the insolvency case of the legal entity of the Russian branch of Radio Liberty* (Radio Free Europe LLC/Radio Liberty is recognized in the Russian Federation as a foreign media agent) (No. A40-42153/2022) was the decision of the Metropolitan Court (AS GM). The arbitration granted the bankruptcy trustee's request to involve the former head of the organization in the subsidy.

Andrei Sharyi, as the ex-head of the organization, will be responsible for the company's debts with personal property. At the same time, similar requirements for the American parent company were denied. The specific amount of financial claims against him will be determined separately, after full settlement with all creditors. 

The insolvency procedure in relation to the Russian division has a long history. The initiator of the lawsuit was the metropolitan Federal Tax Service No. 7. Based on the application of the tax authorities, in August 2022, the court introduced surveillance in the business company – the first stage of bankruptcy. 

In March of the following year, the organization was officially declared insolvent. An important stage was the inclusion in the register of debt to the fiscal service for an impressive amount – 720.8 million rubles. Its size was approved by an act of the court at the end of 2022. 

Numerous administrative fines have played a significant role in the financial condition of the company. The problems began with legislation on labeling media materials that perform the functions of a foreign agent. Roskomnadzor reported on a multitude of protocols drawn up (about 390 in relation to the organization and its ex-director). 

As a result of the review, 260 of them were fined, the total amount of which reached 71.5 million rubles. In the spring of 2021, the Tverskoy District Court upheld 20 rulings issued in connection with the lack of mandatory labeling on the websites of nine foreign media outlets. Penalties of 5.5 million were imposed. 

In addition, in March 2022, Roskomnadzor initiated the blocking of Radio Liberty's Internet resources*. The reason for this was the refusal to delete data that the agency considered distorted in the context of its own, including information about losses. 

Currently, the bankruptcy proceedings have been extended. Yulia Aga-Kuliyeva has until November 24 of this year to submit to the court either an application for bankruptcy completion or a petition justifying the need for further extension of the procedure.
