THE COURT BEGAN CONSIDERING THE BANKRUPTCY CASE OF THE POLISH OIL CONCERN ORLEN
The Court of the Russian capital (AS GM) has begun considering a lawsuit demanding that the Orlen concern be declared insolvent.

As Rusbankrot previously reported, the initiator of the process was the Yamal-based Enterprise Mechanization. The plaintiff referred to the court decision on the recovery of 5.5 million rubles (No. A40-159651/2025), which was not executed by the Polish oil concern. 

The legal dispute has a long history, dating back to 2002, when the Russian company and the Polish PGNiG (later incorporated into Orlen) became neighbors in a building on Vavilova Street. The key point of the conflict was the use of the lobby belonging to the Mechanization Enterprise by employees of the Polish structure to access their premises. The lack of a written agreement on such an easement subsequently became the basis for financial claims.

In 2024, the Russian lender sent an official request for payment for the long-term use of the lobby, but received no response. This allowed us to go to court, which granted the claim in full in the spring. It is noteworthy that at all stages of the proceedings – both on the issue of foreclosure and at the first bankruptcy hearing on November 20 – representatives of Orlen were absent. 

The insolvency procedure for a foreign entity has become possible due to the presence of assets in Russia, which creates the necessary link with the jurisdiction. CJSC Enterprise Mechanizatsiya itself has already had bankruptcy experience: To settle with creditors, the company was forced to sell several real estate properties, including two metropolitan offices and a recreation center. 

Interestingly, this is not the first attempt to initiate bankruptcy of assets associated with PGNiG. In the summer of 2024, arbitration had already terminated similar proceedings initiated by the tax authorities due to a debt of 3 million rubles, since the debtor legal entity ceased to exist after consolidation with Orlen, officially completed in 2022.
