THE CENTRE FOR LEGAL SUPPORT OF BUSINESS RAISED A QUESTION OF THE CUSTOMS INSPECTIONS

The Moscow Interregional Transport Prosecutor's Office and the Center for Legal Support of Business have launched a series of practical webinars for the entrepreneurs. The first of them was devoted to the legal aspects of the customs activity and the legality of the customs inspections. The event was also attended by the representatives of the customs services of the largest airports of the capital - Domodedovo, Sheremetyevo and Vnukovo as well as the leadership of the Moscow regional customs.



Deputy Prosecutor of the Moscow Interregional Transport Prosecutor's Office, the State Advisor of Justice of the 3rd class Oleg Openyshev noted that the issues of the temporary storage warehouses and the on-site customs inspections are in the focus of attention of the Moscow Interregional Transport Prosecutor's Office. Over the past year, the prosecutor’s office registered 5,000 documents on the state ownership of the goods from the temporary storage warehouses. What is more, the violations were recorded during the execution of the results of inspections, fixing their codes, and delaying the inspections schedule overrun.

For his part, Aleksey Mishin, the Head of the Center for Legal Support of Business and the member of the Council of Business Russia Organization, emphasized the importance of transparent and clear rules for the interaction of the customs and the representatives of business.

“In a pandemic, we see a significant decline in business activity, and now any additional pressure factors on the business should be minimized as much as possible,” he said.

Among the proposals of the of the members of Business Russia Organization and the experts of the Center for Legal Support of Business, there are a ban on conducting on-site scheduled customs inspections, conducting and extending the terms of any inspections only with the consent of the prosecution authorities, as well as creation of the mechanism for compensation of the losses that might be incurred by entrepreneurs as a result of unreasonable inspections. The problem of untimely taking of the state property out of the warehouses (TSW) has been raised as well.
