The bankruptcy of the co-owner of the ABC of Taste was confirmed by appeal
The appeal (9th AAC) at the end of May confirmed the verdict of the first instance. The court recognized the legality of the bankruptcy decision of V.M.H.Y. Holdings. This Cypriot structure owns shares (about 10-12%) in the capital of the holding company, which manages the well-known trading network ABC of Taste.

The requirements of the Deposit Insurance Agency (DIA) acting on behalf of the bankrupt M2M Privet Bank became the basis for the introduction of bankruptcy proceedings. In February of this year, the Moscow Arbitration Court (AS GM) satisfied the claim of the DIA Group of Companies, including debt of 18.6 billion in the register of the Cypriot legal entity. Within this amount, the main debt amounted to 1.5 billion rubles. However, along with it, various fines and penalties were accrued.
 
The court pointed to the stable connection of the Cypriot debtor with Russia. In particular, a significant number of transactions related to the company's assets were concluded in the Russian Federation. The company's creditors also included Russians and organizations from Russia. This made it possible to extend the norms of domestic insolvency law to a foreign structure.
 
According to the case file, the debtor's property included about 12% of the shares of another Cypriot company, Sanimon Corporation Ltd. This is the parent company behind the Russian retail chain. Financial transactions, as the court found out, were carried out through the "City Supermarket", which is on the list of Russian organizations of social importance.
 
In early April, AU GM satisfied another demand, this time from the Trust Bank. Debt in the amount of 5.4 billion was added to the V.M.H.Y. register, of which 378 million are penalties.
 
It should be recalled that the V.M.H.Y. liquidation procedure, initiated by the court in Nicosia seven years ago, remains incomplete. Meanwhile, bankruptcy in the Russian jurisdiction is gaining momentum, opening up the opportunity for bankruptcy creditors to make their claims.
 
M2M Private Bank, whose interests in the case are represented by DIA, lost its license in December 2016. Since February 2017, the financial institution has been declared bankrupt. At the time of the license revocation, it was ranked 155th in the rating of Russian credit institutions in terms of assets. Trust Bank, on the contrary, continues to operate successfully. In the first quarter, it ranked 83rd in a similar ranking.
