THE APPEAL SETTLED 31.4 MILLION FROM THE MANAGER 16+
The Seventh Arbitration Court of Appeal confirmed the recovery of damages from Yulia Bakaminova, the former bankruptcy manager of Energougol LLC. The amount in question is 31.3 million rubles, which the company, according to the court, did not receive due to the missed deadline for including the claim in the creditors' register.
The dispute is related to the bankruptcy of Vyacheslav Eremeev, a controlling party who was held liable for the debts of Energougol. Bakaminova was required to file a claim within two months, but she did not do so until more than 11 months after the determination of liability was issued.
As a result, Energougol's claim was not included in the register. The court pointed out that if the application had been submitted in a timely manner, the company could have received about 43 million rubles from Eremeev's estate, but it actually received 11.7 million rubles. The court recognized the difference as losses.
Bakaminova and the Association of Self-Regulatory Organizations of Asset Management Companies "EUROSIB" attempted to challenge the recovery. They argued that there was no separate court decision confirming the manager's wrongdoing, that the practice was controversial, and that there were errors in the calculations. However, the appeal court rejected these arguments and upheld the decision of the first instance.
