THE APPEAL REJECTED THE CLAIM FOR THE RECOVERY OF 490 MILLION FROM THE CHELYABINSK DEPUTY
On July 3, the Court of Appeal (18th AAC) overturned the earlier verdict on the recovery of almost 500 million rubles from Yuri Karlikanov, who holds the post of deputy chairman of the Chelyabinsk Legislative Assembly, his daughter and the Kapitalinveststroy enterprise. Instead, the appeal issued a new ruling. It contains a refusal to satisfy the claims of the plaintiff, Nikolai Nikolsky.

Nikolsky is a creditor of the bankrupt company Regionsnabsbyt. Two years ago, he sent a statement to the court, asking to recover 490 million. He had previously received the right of claim from Yuzhuraltrans. According to his position, the company's assets were withdrawn illegally. The property list includes a promissory note for 250 million and a license granting the right to mine building stone. These actions, according to the applicant, caused damage to creditors. 

However, the defendants did not agree with the arguments. Yuri Karlikanov, his daughter Yulia Alexandrova, as well as the Kapitalinveststroy company, headed by the latter, filed appeals. They insisted that the mentioned transactions had already been the subject of analysis during the bankruptcy procedure of Regionsnabsbyt and had previously been recognized as legitimate. 

Among other things, the materials indicated that similar claims had already been made by another creditor, Yuzhuraltrans, during an attempt to challenge the deal with Chelyabinsk–City. Then the courts concluded that the payment for the transaction had been made in full. In addition, the transaction on the transfer of the business related to the extraction of stone has already been considered in the framework of the case on bringing controlling persons to subsidiary responsibility. 

It should be recalled that Regionsnabsbyt has been operating since 1995, specializing in the extraction of building and decorative stone, limestone and other minerals. The company was declared bankrupt in 2014. At that time, the Karlikanov family owned more than 99% of the authorized capital: 80.14% belonged to Yuri Karlikanov, and almost 20% to his son Denis. 

After the bankruptcy of Regionsnabsbyt, the Karlikanov family business continued to exist under other legal entities related to the construction and mining sectors. Among them are Stroycapital, Regional Mining Company, Nerudprom, Mixtures and Concretes, as well as a number of other companies that have repeatedly appeared in insolvency cases. 

Experts believe that this practice of changing legal entities against the background of bankruptcies has been observed in the family's business model for several years. Yuri Karlikanov has represented the Chelyabinsk Region in the Legislative Assembly since 2005 and has held senior positions since 2009.
