THE APPEAL CONFIRMED THE DEBT OF THE VOLGOGRAD AGROFIRM TO ALFA-BANK

THE APPEAL CONFIRMED THE DEBT OF THE VOLGOGRAD AGROFIRM TO ALFA-BANK
A major creditor of the agricultural enterprise JV Irrigated has secured confirmation of its property rights through arbitration. Alfa-Bank asked the court to include debt secured by collateral in the register of claims. We are talking about an amount of over 618 million rubles, of which 496 million are basic obligations, and the rest are accrued interest. The Arbitration Court of the second instance, having considered the appeal, upheld the original decision, rejecting the debtor's objections regarding the amount of the penalty.

In the autumn of 2024, three loan agreements were concluded between the bank and the agricultural company. As collateral for the obligations, the company pledged real estate, land reclamation complexes and lease rights to agricultural land with a total area of more than 2,000 hectares. After checking the submitted documents, the court found that the claims were justified and, moreover, confirmed by a pledge.

The financial situation of JV Irrigated, despite the announced profit of 228 million rubles by the end of 2024, turned out to be unstable. Already in February 2025, the company initiated its own bankruptcy procedure, pointing out the inability to pay off numerous creditors. Among them are financial institutions such as Sberbank, Unicreditbank and Finagrotech. The total amount of the company's obligations to fourteen creditors exceeded 1.7 billion rubles.

The legal twists and turns of the case were accompanied by attempts by affiliated structures, including Finagrotech and Finagro Trade, to suspend the trial. However, the arbitration found no reason to grant such requests, pointing out that parallel court proceedings are not an obstacle. In September 2025, a bankruptcy procedure was introduced for JV Irrigated, which will last until the spring of 2026.

The court's attention was drawn to the significant gap between the book value and the market value of assets. Land reclamation systems, which, according to accounting, cost over 1 billion, were estimated at only 100 million rubles. At the same time, a criminal case has been opened against the founders of the company, Evgeny Akutnev and Viktor Cheryachukin. They are suspected of overstating the cost of land reclamation projects and embezzling more than 600 million, as well as hiding funds intended for paying taxes.
