The Moscow company A-5 (INN 7713425383), specializing in the wholesale trade of heating and plumbing equipment, warned the Tambov company InkomNefteRemont (INN 7709424027) of its intention to initiate its bankruptcy. The publication was posted on the Fedresource portal.

On May 21, 2024, the court partially satisfied the claim of A-5. The Arbitration Court of the city of Moscow ordered the defendant to pay the principal debt and the accrued penalty. The recovery of interest (under Article 395 of the Civil Code of the Russian Federation) was refused.
InkomNefteRemont tried to appeal the decision of the Moscow Arbitration Court on appeal (Ninth Arbitration Court of Appeal). In the applicant's opinion, the Moscow arbitration court did not fully clarify all the circumstances relevant to the case. In particular, it was pointed out the incorrect calculation of the penalty, the absence of a deadline for final payment in the contract and the refusal of the Moscow Arbitration Court to postpone the court hearing at the request of the defendant. However, the arguments presented did not affect the verdict of the court, and the complaint was denied.
