SURVEILLANCE HAS BEEN INTRODUCED AGAINST THE MAGNITOGORSK DUMP TRUCK SUPPLIER
The Chelyabinsk Arbitration Court found the applicant's arguments convincing and launched the first stage of bankruptcy proceedings against Vostoktyazhmash. The claim was based on which the creditor demanded that the company be declared insolvent (case no.A76-5402/2026). The authority has introduced surveillance. The bankruptcy stage is scheduled until September 3. It is on this date that the preliminary results are scheduled.
The initiator of the proceedings was Sberbank (PJSC), which filed an application in early February. At a hearing on April 22, the court confirmed the validity of the creditor's claims. Now the debt in the amount of 51.2 million rubles will be included in the register of claims in the third row. Of these, the main debt is just over 50.2 million rubles, plus a state duty of over 771 thousand and a penalty of 112.8 thousand.
The interest on the debt is symbolic. But there is an important caveat: all penalties will be repaid after paying the principal and interest, they will be counted separately.
The temporary manager, Eduard Chu, was entrusted with monitoring the debtor's financial condition at the monitoring stage. The specialist represents the union "SRO AU of the North-West". It is he who will analyze the assets and liabilities of the company, and then form the final register of creditors' claims.
The credit institution has previously tried to return the money through the court. Last year, the arbitration court granted Sberbank's claim for the recovery of 53.2 million rubles. And not only from the legal entity itself, but also from its management. The defendant tried to appeal the decision, but the complaint was rejected, leaving the verdict unchanged.
The introduction of surveillance was a logical continuation of the conflict between the bank and the supplier of dump trucks from Magnitogorsk. The subsequent procedure will determine the further course: the debtor's real financial capabilities will be analyzed, after which the court will decide whether to proceed to the next stages or not.
