SUPREME COURT: REHABILITATED CITIZEN IS OBLIGED TO REIMBURSE THE COSTS OF LAWYERS
As part of the criminal case, an acquittal was issued against a citizen, which recognized the defendant's right to file an application for compensation for criminal prosecution. Based on the results of consideration of such a citizen's application, the courts partially satisfied the claim, considering that part of the expenses for lawyers was not justified by them.

A citizen appealed to the Constitutional Court of the Russian Federation with a complaint against the norms of the Criminal Procedure Code of the Russian Federation, which allow the court to reduce the amount of compensation almost arbitrarily during his rehabilitation.

The Constitutional Court issued a ruling, pointing out that the issue of the constitutionality of the norm challenged by it was resolved in an earlier court ruling, where it was concluded that a reduction in compensation was permissible only in cases where the expenses claimed for the recovery of lawyers were not related to the criminal case.

The Presidium of the Supreme Court of the Russian Federation annulled the judicial acts of lower courts with reference to this definition and sent the case for a new hearing.
