ROSGOSSTRAKH DEMANDS BANKRUPTCY OF FORMER TOP MANAGER
PJSC IC Rosgosstrakh has initiated bankruptcy proceedings against its former head, Daur Genia, who was convicted in absentia and is on the international wanted list. The claim for declaring him bankrupt was filed with the Moscow Arbitration Court (ASGM). The date of consideration of the application has not yet been set, but the fact of filing a claim has already been recorded in the file of arbitration cases.

The reason for Rosgosstrakh's appeal to arbitration was an earlier judicial act. In March last year, the Dorogomilovsky Court in Moscow found Daur Genia guilty of abuse of power.

According to the court, the actions of the accused caused significant damage, and in this regard, the insurance company's civil claim for more than 1.2 billion rubles was satisfied. The sentence provided for a penalty of eight years in prison, which will begin to be calculated from the moment of Genia's detention or his extradition to Russia.

Previously, the defendant served as the head of Capital Reinsurance CJSC, which was part of Rosgosstrakh until 2018. In October of the same year, the company was reorganized by joining the parent structure, and its assets and liabilities were transferred to a new legal successor. This was followed by a claim for damages incurred as a result of the controversial actions of the ex-head. 

According to the materials of the arbitration proceedings, Genia made decisions alone, without coordination with the supervisory authorities of the group. One of the key claims was the alienation of the Medsis medical company from the insurance holding company, which included a wide network of various divisions. 

According to Rosgosstrakh, as a result of this transaction, significant assets were withdrawn from its control. The customer base decreased by 200 thousand insured persons. The total damage is estimated at 2 billion. 

Genia left the territory of Russia in 2020. Despite active search efforts, including international inquiries and verification of Georgia's border databases, his whereabouts have not yet been established. Interpol, which is involved in the case, has not yet given a result. 

Rosgosstrakh is trying to compensate for the damage caused through the personal bankruptcy procedure of the former top manager. The very fact of going to court can become an important element in a strategy to protect the interests of the company and fix property claims. But collecting money from a person who is abroad and hiding from justice is a legally and factually difficult task.
