PELLA SHIPYARD MAY BE DECLARED BANKRUPT DUE TO DEBT OF 536 MILLION
The shipbuilding plant "Pella" from the Leningrad region may be among the bankrupt. The arbitration court in St. Petersburg accepted a claim for bankruptcy. The application was sent by the Akademik Shipunov Instrument Engineering Design Bureau (KBP), located in Tula. It is part of Rostec Group of Companies. The total amount of claims against Pella exceeds 536 million rubles.

Formally, the dispute began in 2024, but its roots go much deeper – to the contract concluded in 2016. At that time, Pella and KBP agreed to supply ZM87-1F radar systems and components designed to equip small missile ships of the 22800 project, also known as the Karakurt. The contract was concluded as part of a defense order. 

Later, mutual claims arose between the parties. The Pella plant insisted on collecting 760 million rubles from KBP, pointing out that the equipment was delivered late and had not passed proper tests. According to the contract, it was supposed to be delivered in August 2019, but it was received only in December 2020. 

KBP, in turn, demanded payment of the principal debt in the amount of 569 million rubles, as well as 276 million rubles in penalties. The case was considered in several judicial instances. The first of them, in January last year, recognized Pella's claims as partially justified, awarding her a symbolic sum of 1 million. All the requirements of the KBP were rejected at that time. 

However, the appeal (13th AAC) revised these findings. He admitted the fact of violation of delivery dates by KBP and reduced the amount of the penalty to 132.8 million. At the same time, the court found that the equipment, despite the disputes, was used in the construction of the ship transferred to the Ministry of Defense, but it was never paid for. 

The result of the trial was a settlement, according to which Pella's debt to KBP amounted to 536.8 million rubles. The company was also ordered to reimburse court costs in the amount of 124.4 thousand rubles. The KBP's attempt to involve the Ministry of Defense in the case proved fruitless: The court concluded that the agency was not involved in the dispute. As a result, the debt obligations under the defense contract became the reason for the threat of bankruptcy of one of the largest shipyards in the region.
