Money after divorce: when the demand becomes current
As part of the bankruptcy case (No. A55-30119/19), the debtor's ex-wife requested that monetary compensation for the division of property be included in the register.

The courts of two instances restored the missed deadline for filing a claim and recognized the claim of the debtor's former spouse in the specified amount as justified and subject to inclusion in the debtor's register.

The cassation terminated the proceedings on the application, based on the fact that the debtor's former spouse's claim for monetary compensation, which arose on the basis of a judicial act, is related to the division of the spouses' common property. Since the judicial act on the basis of which the claim arose entered into force after the debtor's bankruptcy proceedings were initiated, this requirement is current within the meaning of the law.
