KORKUNOV'S CREDITORS APPEALED THE TERMINATION OF BANKRUPTCY
The Moscow Arbitration Court (AC GM) in October completed the insolvency case of the famous entrepreneur, founder of the chocolate factory "A. Korkunov" by Andrey Korkunov, a settlement agreement was signed on it. However, this court decision provoked a protest from two creditors. As a result, a complex legal story related to the insolvency procedure is unfolding around the person of the ex-pastry chef.

As Rusbankrot previously reported, financial manager Levchuk, the Dynamics company and the person representing the creditors' meeting agreed on a settlement agreement. According to its terms, Dynamics undertook to pay for Korkunov with three creditors: the regional Ministry of Land and Property (about 607 million rubles), a bankrupt bank (about 2 million) and the Themis law agency (about 6 thousand). 

The Deposit Insurance Agency (DIA), representing the interests of the bankrupt Ancor Bank, as well as the Femida company, filed appeals seeking a review of the decision to terminate the proceedings. The consideration of their claims is scheduled in court (9th AAC) for mid-January. 

The DIA insists that stopping the insolvency process poses a threat to the protection of creditors' interests. The agency recalled that demands were made to the businessman for a subsidy on the bank's debts of almost 5.9 billion rubles. 

In addition, experts point out that there is a high risk of losing the opportunity to take the initiative to re-bankruptcy proceedings in respect of foreign assets. Earlier, the media reported that there are several real estate properties in Los Angeles registered to the entrepreneur's wife. 

As part of the procedure, two Moscow garages (for about 3.7 million) and a Yamaha motorcycle (for 400 thousand) were sold. The request to restrict Korkunov's departure from the country was not granted, as the courts found that he had not actually lived in Russia since 2017. 

The DIA is particularly concerned about the possible affiliation of the Dynamics company with the Ministry of Land and Property of Tatarstan, which, according to the agency, could affect the format of the concluded agreement. Initially, the debtor himself opposed the approval of the settlement agreement, but the court found its terms acceptable. 

The founder of the Korkunov chocolate brand also owned Kazan Tatecobank in the past, which was later renamed Anchor Savings Bank. After leaving the confectionery business, which he sold to Wrigley and Mars corporations, Korkunov headed the board of directors of this bank.
