IT WAS NOT POSSIBLE TO ESTABLISH THE PREMEDITATION OF THE BANKRUPTCY OF THE SARATOV CONFECTIONER

The insolvency proceedings of the Saratovskaya confectionery factory (Consar JSC) turned out to be fraught with a number of difficulties. The attempt of the bankruptcy trustee Yulia Verkhovtseva to find out whether the bankruptcy was intentional or occurred for reasons beyond the control of the factory management turned out to be doomed to failure. Documents are required for verification, and Verkhovtseva did not have them.

In March 2022, Rusbankrot already reported the bankruptcy of the factory. The initiator of the process was the Saratov company "Lario", which filed a claim in November 2020 for more than 2.76 million (case no. A57-31896/2020). In July 2021, Consar was taken under surveillance. The court entrusted the functions of the interim manager to Yevgeny Lashmanov.

On March 16, 2022, the arbitration of the Saratov Region instructed Verkhovtseva to conduct a bankruptcy procedure. She had to study the documents on the contract that the factory concluded with the TD "Sweet product". However, there were no papers, despite the fact that both organizations were registered at the same address.

TD "Sweet Product" also turned out to be bankrupt. His bankruptcy trustee Evgeny Benkovich also found no signs that the insolvency is fictitious. However, there was no data to check the company for the premeditation of bankruptcy. The property assets of the trading house turned out to be only claims in the amount of 177 million, representing accounts receivable of Consar JSC.

TD "Sweet Product" was the guarantor of the factory on a loan in the amount of 651.1 million. This, according to experts, was the main reason for the subsequent bankruptcy. At the same time, the attempt of Sweet Product to enter the register of creditors of the confectionery factory was unsuccessful. The court of the organization refused.

The only deal between Sweet Product and Consar turned out to be a 2018 agreement. According to it, the rights of claim in the amount of 28 million were ceded. Benkovich does not give up trying to challenge it.

At the end of 2022, the production workshops of the factory were acquired by Lyudmila Sutkevich, a Kirov resident. The transaction amount amounted to 231.6 million rubles. Part of the fleet was sold off in early 2023. The remaining GAZ truck and several trailers in the assets of the factory were not in demand. Auctions for them, scheduled for April 10, did not take place due to lack of demand.
