A new financial conflict is breaking out in Kamchatka over the bankruptcy procedure of a local contractor. The regional institution "Kamchatupravtodor" filed a lawsuit against the construction SRO. The subject of the dispute is almost 184.3 million rubles in damages, which the plaintiff wants to recover as part of subsidiary liability. The basis for such claims is a violation of contractual obligations by a company that was previously a member of this association.
The key amount of the proceedings was formed after an unsuccessful attempt to return the advances issued for the reconstruction of two crossings. The customer transferred more than 278 million rubles in advance to Alfasnab. However, the regulatory authorities later discovered that the winning bidder had provided false information about his experience. As a result, the Supreme Court of the Russian Federation and lower courts declared the transactions invalid.
Not everything was returned. 110.7 million and 167.3 million rubles were recaptured through enforcement proceedings, but this did not result in full repayment of the debt. And in November 2024, Alfasnab initiated its own bankruptcy. The customer now considers the remaining unpaid funds – 184.3 million – to be a direct loss and wants to receive it from the SRO, since the company was paying contributions to the association's compensation fund at the time of signing the papers.
According to the law, if contracts are concluded based on the results of a fair competitive procedure, a self-regulating organization is obliged to be responsible for the debts of its participant in a subsidiary manner. The arbitration court has already accepted the claim for consideration. The first hearing is scheduled for mid-May 2026.
This situation is not unique in the construction industry. In parallel, a similar dispute is being considered in Primorye. In April, Stroydor Service demanded 1.35 billion rubles from the regional Ministry of Transport. The lawsuit is related to the termination of the contract for the repair of the Mikhailovka–Dalnoye highway. The contractor claims that he has already spent most of the money received on the work, which the customer accepted without comment. But the payment has not been made yet.
