The day before, it became known that the Committee for Security and Anti-Corruption of the State Duma had prepared a draft law providing for amendments to the Criminal Code (Criminal Code of the Russian Federation).
We are talking about the introduction of a new article for illegal collection activities in terms of the use of violence or the threat of such use, as well as in terms of causing damage to both citizens themselves and their property.
The regulation may appear in the form of additional article 172.4 of the Criminal Code of the Russian Federation, the punishment for violation of which will be up to 5 years in prison, and if an act is committed by an organized group - up to 12 years.
At the moment, when the articles of the Criminal Code of the Russian Federation are applied to such actions, the regulations concerning harm to health, as well as threats of murder, extortion and violation of the inviolability of the home are applied more frequently.
The experts' opinions on the need to introduce a separate article with responsibility for collectors have divided.
On the one hand, the introduction of a separate liability regulation in the Criminal Code of the Russian Federation is intended to sober up the "hotheads". On the other hand, the code already contains the necessary tools for this. The addition of another article could lead to greater impunity on the part of debtors and an increased risk of non-repayment of debts for their creditors.
