GOOGLE IRELAND BANNED FROM LITIGATION IN THE UNITED STATES IN THE BANKRUPTCY CASE OF GOOGLE'S "DAUGHTER"
The Moscow Court (AS GM) has upheld the petition of the bankruptcy trustee of the Russian company Google (the Russian legal entity Google), imposing a ban on the parent foreign company Google Ireland Ltd. to participate in the consideration of the insolvency of his "daughter" in arbitration proceedings in the United States. The verdict was established within the framework of security measures.

Valery Talyarovsky, CEO of Google, sent an appeal to the AU GM, demanding that Google Ireland be banned not only from conducting business in international arbitration proceedings, but also from initiating similar processes in other American courts. In his statement, there is a provision according to which, in case of violation of this prohibition, 65.1 billion rubles must be recovered from the company. The next hearing on this lawsuit is scheduled for September 10. 

Recall that Google in the Russian Federation received bankruptcy status back in the fall of 2023. Talarovsky had previously applied to the judicial authority with a petition to invalidate a number of contracts concluded between a Russian legal entity and its foreign parent structure. KOO also demanded that Google Ireland be involved in the subsidy. 

According to KOO, representatives of a foreign firm demanded that the litigation in Russia be stopped, citing corporate agreements and the arbitration clause contained in them. According to her, the contracts stipulated that disputes should be considered by a commercial court in the United States. Subsequently, Talyarovsky received a notification that the American court had already accepted Google Ireland's claims against the Russian Google and personally against him. The meeting on them is scheduled for September 18. 

AS GM noted that a ban on a foreign person to conduct proceedings against Google LLC in courts outside Russian jurisdiction has already been introduced. However, the organization ignored this decision of the Court of the Russian Federation, continuing to conduct proceedings in the Northern District of California. 

The court pointed out that by its actions a foreign company could disrupt the bankruptcy procedure. After all, in the case of execution of decisions of a foreign court, the Russian company will lose the opportunity to form a bankruptcy estate and challenge transactions, which will damage creditors. According to the court, interim measures are necessary, given the scheduled hearing in the United States on September 18. 

Thus, the court found Talyarovsky's arguments convincing. The Moscow Arbitration Court considered that only the limitation of foreign proceedings would ensure the full-fledged bankruptcy proceedings of the Russian Google without loss of meaning.
