Six representatives of the top management of Lightbank will bear subsidiary responsibility. The Arbitration Court of the Moscow District, which received a cassation appeal against last year's decision of the Moscow arbitration court, upheld the verdict. The metropolitan Arbitration Court has previously arrested the property of the CDL brought to justice.
On December 10, 2021, Konstantin Toguzaev, Alexander Kazarnovsky, Andrey Suryadny and several others were brought to subsidiary responsibility. Toguzaev was the chairman of the Board of Lightbank, the other two were his deputies. Vladimir Toguzaev, the former chairman of the Supervisory Board of the bank and two of its members, also had to answer for the debts of the credit institution.
Citizens tried to challenge the December decision of the AC GM in the appellate instance, but failed. Four of the six persons then filed a cassation complaint. Now it has become known that the district court also did not support her. This means that all persons will have to share responsibility, the approximate amount of which experts estimate at 1.2 billion rubles.
Lightbank was established in 1994 as an LLP (limited liability partnership). He lost his license at the end of March 2018, and subsequently became bankrupt (case no. A40-86173/2018). The regulator's decision stated that the commercial bank systematically failed to comply with federal laws and regulations of the Central Bank.
During the bankruptcy process, it turned out that the persons who controlled the bank's activities made decisions on virtually non-repayable loans. Some of the money from the bank's cash desk turned out to be stolen. His clients suffered losses. The central bank reported that in the process of studying the bank's assets, a shortage of 144 million rubles was established. There were signs that the assets were withdrawn through one-day firms that do not conduct economic activities.
During the bankruptcy of Lightbank, creditors also managed to challenge the estimate of the bankruptcy trustee (DIA), who planned to spend about 5 million rubles on legal and accounting services. The analysis of the DIA reports conducted by the lawyers of the creditors' committee found duplication of functions. As a result, expenses through the court were halved.
