The arbitration of the Khanty-Mansi Autonomous Okrug found the persons who controlled the activities of SeverStroy Partner guilty of ruining the company (case no.A75-20726/2019). As a result, the ex-beneficiaries of the company, Bogdan Nestor and Andrei Kopaigora, were involved in the subsidiary. Together with them, the financial responsibility will be shared by the ex-head of the company Svetlana Panteleeva. According to the court, their actions made it impossible to satisfy the organization's obligations to creditors.

At the very beginning of the litigation, a problem arose with determining the role of each of the defendants in controlling the activities of the legal entity. Panteleeva served as director until August 2019, and Nestor and Kopaigora were the undisputed owners of the organization, controlling it through a network of affiliated organizations.

The application for a subsidy was submitted by bankruptcy trustee Konstantin Korolev, according to whom financial assets were deliberately withdrawn from the company. This is what worsened the already unfavorable position of the company and led to insolvency.

According to the accounting department, over several years (from 2016 to 2018), the company has accumulated large assets. In 2016, their amount amounted to 1.4 billion, in 2017 – 2.9 billion, and a year later – 2.3 billion. But since the middle of 2017, the organization has increasingly found itself in debt to counterparties. As a result, through arbitration, it was established that the accounting data did not correspond to the actual situation of the enterprise. This eventually led to bankruptcy.

The court drew attention to some transactions that were recognized as fiction during the insolvency process. Through them, 267.6 million rubles were withdrawn from the organization's current accounts. Creditors' rights suffered, and a case was opened against Nestor for criminal embezzlement of shareholders' funds.

During the proceedings, the defendants indicated to the court that they were not involved in the withdrawal of assets. Kopaigora stated that his business partner actually managed the company. He did not sign any financial documents himself, and he did not receive any material benefits from concluding contracts. Panteleeva also reported that from November 8, 2016 to August 2, 2019, she was only nominally listed as a director, having issued a power of attorney to conclude all transactions to another person. But the court did not accept these arguments.

The size of the subsidy is still uncertain. The case was suspended on this issue until settlements with creditors are completed. The company was declared insolvent in 2020. Its bankruptcy is one of the examples of unfair asset management in the construction industry.
