EX-HEAD OF KRASNODAR DEVELOPER AVOIDED COLLECTION OF SUBSIDY
The Krasnodar Arbitration Court (AS CC) refused to assign Ruslan Kondrashenkov, who once headed the Greenwood firm, the obligation to repay the debts of the bankrupt company. The verdict was issued following a review of the claims of the bankruptcy trustee (KU) Sergey Simonov, who insisted on involving the ex-head in the subsidy.

Previously, petitions from several creditors were combined in one proceeding. KU, appointed in 2021, sought to recover 561.7 million rubles from three ex-executives. Kondrashenkov was also on this list. In addition, several companies (Center-Asset and Stroypodryad) filed petitions demanding to impose liability on other persons. As a result, both a legal entity (Bank Clientsky, firms Europa City and Energia) and an individual (Svetlana Elina, Sheermadin Marganiya) appeared on the list of possible defendants. The bank, in turn, stated that the "Asset Center" should be considered the controlling structure in relation to the debtor. 

However, in the case of Kondrashenkov, the AC CC conducted a separate detailed analysis. He has held the position of CEO for a short time since October 2014. In the summer of 2015, the manager quit. At the same time, the company violated his labor rights by not paying his salary for two months, leaving him without compensation for his vacation and without severance pay. The ex-director managed to get his work record only on September 18, 2015. These facts were established by one of the regional courts of Krasnodar. 

Having studied these circumstances, the arbitration court concluded that at the time of October 2015, all documentation, seals and assets remained under the control of Greenwood, and not the former head. Thus, there was no evidence of Kondrashenkov's actual control over the company during the critical period. This served as the basis for the refusal to satisfy the claims of subsidiary liability.

Recall that the Greenwood company, which gained fame in connection with the Europa-City residential complex project in Krasnodar, received the status of an insolvent company in 2018. The initiator of the process was the bank "Client" through the Group of Companies "DIA". The developer planned to build a business-class residential complex, having secured a partnership agreement from the Center-Asset company and a mortgage from large banks. 

According to open sources, the company's assets grew in 2013-2015, but at the same time accounts payable increased rapidly, and the activity ended in losses. A legal entity with an authorized capital of 20 thousand rubles remains registered in Krasnodar.
