EUROCHEM DROPPED ITS CLAIM AGAINST ITALY'S TECNIMONT FOR 31.8 BILLION
Eurochem, a major global producer of agrochemical products, has withdrawn its lawsuit against the Italian engineering group Tecnimont S.p.A. and its subsidiary in the Russian Federation (MT Russia) from the Moscow Court (AC GM). The total amount of the initial claims amounted to over 31.8 billion rubles.

The basis of this legal conflict is the terminated contract. It was assumed that a production complex producing ammonia and carbamide would be built on the territory of the Leningrad Region. The customer of the project was Eurochem North-West-2. In the summer of 2020, the company signed an agreement with Italian contractors. 

After the termination of the agreement, Tecnimont initiated a lawsuit in international arbitration. The customer was accused of failing to comply with the conditions. In response, the Russian firm filed counterclaims, expecting to receive ˆ380 million for the unused advance, ˆ571 million in additional expenses and ˆ875 million in compensation for lost profits. 

The statement of claim was sent to the Russian arbitration court in August last year. But the consideration of the document was suspended due to procedural flaws. The court noted the absence of a properly certified translation of the contract, non-payment of the state fee and the failure to provide evidence that the dispute was being tried to settle in a pre-trial manner. 

Although the arbitration provided the plaintiff with time to correct the deficiencies, Eurochem preferred to file a motion to return the claim. The exact grounds for refusing to continue the process are not specified in the case file. 

At the same time, Moscow continues to consider another application from the same company to the same persons, but for a significantly larger amount (202.7 billion rubles). As part of this lawsuit, the court seized assets of the Italian company and its subsidiary in the Russian Federation for more than 9.5 billion. 

Eurochem Holding, which appeared in 2001, remains the leader in fertilizer production. Its founder, Andrey Melnichenko, has not been a member of the board of directors or a beneficiary owner of the company since the spring of 2022. The Italian engineering group, in turn, is part of the larger Maire Group holding company. Now, as experts point out, he is a leading player in the market of engineering for the processing industry.
