CREDITORS OF THE POULTRY COMPLEX IN BASHKIRIA WERE RELEASED FROM PAYING ITS DEBTS
A court in Ufa (AS RB) refused to impose multibillion-dollar obligations of the bankrupt Bashkir Poultry Complex named after M. Gafuri (BOD) on its largest creditors. The manager (KU) tried to involve two organizations (Farmellinrus Research Center, MAAT Human Rights Center) and several individuals in the subsidy. But the demands were rejected.

The key point of the dispute was a loan issued to the company 11 years ago. Then a specialized developer provided BOD with funds in the amount of about 715 million rubles. Almost immediately, a significant portion of this money went to third companies, including UralKapitalBank and a number of companies. About 323 million were recovered. KOO claimed that the terms of the loan were unprofitable, and BPC itself acted as a formal borrower, in fact providing finance to structures associated with banker Damir Kamilov. 

Analyzing the arguments of the parties, the court concluded that there was no evidence of Farmellinrus' control over the debtor and its interest. On the contrary, the developer suffered losses due to non-repayment of a significant part of the loan. In this regard, the court found no grounds for holding the company accountable. 

Special attention was paid to the role of the MAAT Human Rights Center. Three years ago, this organization bought out BOD's debt from the NW, becoming a new creditor. KOO felt that demands should be made on the organization. However, the court noted the lack of evidence of affiliation between MAAT and the debtor, and the insufficient evidence base as a whole. As a result, the claims against the center were rejected. 

At the time of the case, the defendants' assets were under arrest. Representatives of Farmellinrus stated that such measures could jeopardize the interests of shareholders, since the company is engaged in the construction of residential complexes in the capital. 

Farmellinrus is one of the main creditors in the BOD insolvency process. It was the NW that initiated the personal bankruptcy of the former co-owner of the company, Marcel Yusupov. It is known that two years ago the MAAT legal center liquidated the debt of another Ufa structure previously associated with Yusupov's business.
