The Constitutional Court of the Russian Federation considered the complaint of a resident of the Krasnodar Territory, who turned out to be a victim of extortion of an aid-man of the local morgue.  The man was forced to pay to get the body of his own mother.  Subsequently, the act was recognized as a crime, but the court refused to pay compensation for non-pecuniary damage.

The incident took place four years ago, when 6 thousand rubles were fraudulently obtained from Sergei Shilovsky when he received the body of his deceased mother.

After that, the law enforcement officers initiated a case, and the victim demanded a monetary compensation for the moral harm caused to him. However, the courts considered that in such a situation the law did not establish the possibility of compensation, since the act incriminated to the morgue employee was a crime against property, reports TASS.

However, when considering the complaint, the Constitutional Court of the Russian Federation indicated that the very fact of committing crimes from this category does not exclude the infliction of moral harm, especially in the case of a person in a difficult life situation, which is the death of his own mother.

Now Shilovsky's claims will be reconsidered by the court, taking into account the position voiced by the Constitutional Court of the Russian Federation.
