ACS RECOVERED HALF A BILLION RUBLES OF LOSSES

The arbitration manager Denis Penkov was charged 500 million rubles for losses caused as a result of improper performance of his duties. The information is presented in the file of arbitration cases - case A45-14821/2016.

Penkov was appointed bankruptcy trustee in the bankruptcy case of LLC "Russian Merchant", an application for which was filed by the collection agency "Broker-Consult". In 2017, the court declared the company bankrupt.

In 2022, the company appealed to the court with a demand to recover 1.2 billion rubles from the arbitration manager. According to the plaintiff, Penkov did not do enough to ensure the safety of the property. Thus, he did not challenge the debtor's transactions with respect to a number of affiliated persons, including: LLC "Alenka Store", LLC "Retail Center", LLC "Trading network Siberia" and LLC "Capital".

The arbitration partially approved the bankrupt's application and ordered Denis Penkov to pay 498 million rubles in damages.
