THE FORMER PRESIDENT OF RUSSIA MIGHT GAIN A RIGHT FOR AN UNLIMITED INVIOLABILITY

A draft law on the inviolability of the former president of the Russian Federation has been submitted to the State Duma - this will complicate the procedure for depriving the immunity status and will prohibit him from being sued not only for the acts committed during his service, but also at any other time.



As reported by "RIA Novosti", at the moment, there is a partial immunity of the ex-presidents - they cannot be brought to criminal and administrative responsibility for actions committed during the presidency. They are also prohibited from being searched, detained, interrogated, or arrested for situations connected with their “former work”.

The draft law will expand the inviolability of ex-presidents to an unlimited period of time.

At the moment, it is possible to lose the inviolability status in the event of a criminal case on a serious crime related to abuse of power during work. The chairman of the Investigative Committee has the authority to do this, and he must send a request to the State Duma.

Now it is assumed that only the Federation Council will have such powers after the State Duma's charges of treason or other serious crime. After that, the accusations will be confirmed by the Constitutional and Supreme Courts.

The initiative to lift inviolability should come from at least 1/3 of the State Duma deputies, and the decision of the Federation Council can be approved by a vote of at least 2/3 of the participants.

If within 3 months the decision to lift the ex-president’s inviolability is not made, the application will be rejected.
