ROSREESTR'S DECISIONS CAN BE APPEALED OUT OF COURT
The Cabinet of Ministers has submitted a bill to the State Duma, according to which it will be possible to appeal in a pre-trial manner decisions on the suspension of cadastral registration and state registration of real estate rights. Currently, the legislation does not provide for a pre-trial procedure.
The bill is intended to reduce the burden on the courts. As follows from the document, special appeal commissions will be created for appeal: central, regional and interregional. Which commission the claim will be sent to depends on which state registration authority made the decision.
Citizens and their representatives, cadastral engineers or organizations in which they work will be able to apply. It will be possible to appeal the decision on suspension within 15 working days from the date of its adoption in writing or electronically or in the form of a postal item.
