A draft strengthening the housing rights of underage orphans has been submitted to the State Duma.
At the moment, the debts of the testators are transferred to the heirs along with the property. At the same time, persons who receive a share in the inheritance without fail accept it regardless of the will and the order.
The bill submitted to the State Duma by Deputy Yaroslav Nilov provides for amendments to the Civil Code of the Russian Federation. As the author noted, orphaned heirs should not, taking into account the mandatory share in the inheritance, take over the debts of testators.
It is proposed to amend Article 1175 of the Civil Code of the Russian Federation. According to the amendment, orphaned minor children are not liable for the obligations of the testator in terms of inheriting their property, which is the only housing.
If the amendments are adopted, creditors will not be able to take away the only living space from underage orphans to repay the obligations of their deceased parents.
