Several deputies of the lower House of Parliament took the initiative to amend the Federal Law ‘On Mortgage’. Parliamentarians proposed this to support borrowers who have made a delay in payment, while the disputed housing is the only one for them.

The day before, a draft law, which provides for a two-year delay in the eviction of payers who have overdue mortgage payments, was submitted to the State Duma of the Russian Federation.  The bill is aimed at regulating legal relations that are associated with the recovery of mortgaged property.
The explanatory note to the document states that eviction from a mortgaged apartment due to late payments is a fairly common occurrence.
This can happen in a situation where the payer made a delay of more than three months.  In this case, the bank goes to court and receives a positive decision, and the family has no choice but to leave.  It does not matter who is registered in the disputed property, including pensioners, young children and the disabled: the law is the same for everyone.

In such a situation, deputies want to protect those borrowers who live in their only home.  The bill proposes to postpone the moment of eviction up to two years from the entry of the decision on eviction into force.  In addition, parliamentarians propose to increase the delay period, due to which the bank has the right to initiate the procedure for the seizure of real estate.  It is proposed to increase it from three to 12 months.
