Federal Tourism Agency is getting ready to send amendments to the legislation on tourism to the representatives of the State Duma. The agency proposes to introduce guarantees for tourists in case the tour operator unexpectedly files for bankruptcy.

The amount of monetary compensation has not been finally determined.  Its cost can be about 40 thousand rubles per person, if the cost of one tour on a beach holiday is taken as the basis for the calculation.

According to her, the current system of financial guarantees in the tourism sector does not provide for mechanisms to protect consumers from sudden bankruptcy of travel agencies.
And although this situation, according to statistics, affected less than 1% of tourists, the prospect of such a ruin of tour operators may be depressing for citizens.

In 2017, amendments to the legislation, obliging travel agencies to allocate funds to two funds at once: the ‘Tourhelp’ Association and the fund of Personal Responsibility, began to operate in Russia.  In the first case, money is needed to evacuate clients of travel agencies who are stuck abroad due to the fault of the tour operator.  According to the law, each operator allocates to it from 50 to 500 thousand rubles annually.

The second fund is used for settlements with clients of a bankrupt tour operator.  The amount of contributions to it is determined within 1% of the price of tourism products of the overseas holidays.  However, in 2020 and 2021, tour operators were exempted from contributions to the first fund, and the amount of payments to the second was reduced by four times (to 0.25%).
This time, the Federal Tourism Agency wants to create a third fund to which tour operators will make contributions as part of their collective responsibility.
According to the agency's specialists, if the company contributes 250 rubles per trip for each tourist to the fund, then it will be possible to collect about 5 billion rubles in a couple of years.  In the event of bankruptcy of one of the market participants, its clients will be guaranteed to be able to receive the minimum compensation from the fund (about 40 thousand).

It is possible that the representatives of the federal agency have data on the possible volumes of bankruptcy of tour operators in the coming years.  None of the experts can say for sure, whether this measure will help if it is adopted at the legislative level.
