ARBITRATION MANAGERS WILL TAKE EXAMINATIONS EVERY THREE YEARS

As a part of the bankruptcy legislation reform, the Ministry of Economic Development of the Russian Federation proposed to conduct midterm examinations for practicing arbitration managers.



If now the manager is subject to an examination after graduation or in a situation of disqualification or a three-year gap in practice, then additional tests of knowledge of the matter for practitioners may appear soon – they will take place once every three years.

The initiative has already received a mixed response from the legal community.

Some consider such a measure unnecessary, since the working managers confirm their qualifications on a daily basis, while others insist that additional tests will motivate professional growth and development.

It is important to note that the additional examination is not the only innovation in this area. The members of the examination boards can be replaced as well. Now the exams are administered by the representatives of the Federal Service for State Registration, Cadastre and Cartography and the educational institution, where the training took place, in equal proportions. The Ministry of Economic Development and Trade proposed to transfer this function to a government-authorized body, which, in turn, will be able to delegate this responsibility to a subordinate organization.

At the same time, the draft law provides for the right to charge a fee for taking the exam, the amount of which will be set separately. This proposal is particularly new, as for the moment, the examinations are free for applicants.
