THE SUBSIDY FOR THE EX-TOPS OF THE "INVESTMENT BANK" WAS UPHELD BY THE SUPREME COURT
The former heads of the "Investment Bank" must pay about 50 billion rubles as subsidiary liability. Ten persons tried to appeal the earlier decision on this to the Supreme Court of the Russian Federation. However, Judge Ivan Razumov did not transfer their cassation complaints for consideration by the Economic Board. The corresponding Ruling (No. 305-ES14-7445) was issued on December 30.

As part of the bankruptcy case of Investbank, which lost its license in December 2013 and received the status of an insolvent credit institution in March 2014, 19 people were involved in the subsidiary. The request for this was sent to the court by the state corporation DIA.

Among the persons involved were all members of the supervisory board of the bank headed by Yuri Matveev, as well as the former chairman of the Management Board Sergey Mendeleev, the owner of the organization Sergey Mastyugin and members of the management board (five people). However, the DIA's request, which was initially granted, was subsequently revised.

In June 2021, one of the former managers of the bank, Vladimir Gezin, who worked as deputy chairman of the Board of the bank in 2012-2013, was sentenced. For embezzlement of more than 12.7 billion rubles, he was sentenced to imprisonment in a general regime colony for three and a half years, collecting 8.3 billion in damages in a civil lawsuit.

Gezin admitted his guilt and began to cooperate with the investigation. However, the banker was not acting alone. The criminal group, according to investigators, included Mastyugin, Mendeleev, Zaitsev and Borgardt. Production on them was continued.

The metropolitan arbitration court decided that new circumstances had arisen (a group of criminals had misled other former top managers) and subsidiary liability should be removed from them. The GM considered the verdict handed down to Gezin as a new circumstance and revised the decision on April 1, 2022. However, the appeal did not agree with the court on July 7. On October 14, the same verdict was upheld in the Arbitration Court of the Moscow District.

Now the Supreme Court has put the final point in the case. He confirmed that Gezin's sentence cannot be considered a new circumstance in the case, as provided for in Article 311 of the APC of the Russian Federation.
