The Arbitration Court of Kemerovo declared bankruptcy of the City-Mall Invest. A company from Novokuznetsk operated one of the largest shopping and entertainment centers in Kuzbass. The initiator of the lawsuit was Alfa-Bank, which applied to the arbitration court at the end of 2020. The amount of financial claims amounted to 4.92 billion rubles, including more than 1 billion of the principal debt.
The shopping and entertainment center in Novokuznetsk was opened at the end of 2013. At that time, it was the largest complex of its kind in the Kemerovo region - its sales area was almost 50 thousand square meters. A year earlier, in November 2012, City-Mall Invest signed a contract with Alfa-Bank on the mortgage lending for construction on several credit lines.
According to the contract, the bank had the right to demand full repayment of debt from the debtor and to seize the shopping center as an object of collateral under certain conditions.
This is exactly what the bank did in 2017, although the grounds arose much earlier. In 2014, the law enforcement agencies began criminal proceedings against Alexander and Sergey Pavlovs, one of whom was the head of the Novokuznetsk Municipal Bank and the other was its co-owner. It was Sergei Pavlov (father) who acted as a surety under the mortgage contract for the construction of the City-Mall.
The criminal case of Sergei Pavlov (he is accused of abuse of power) was referred to court only in March 2020. At the same time, the bank's attempt in 2017 to seize the shopping and entertainment center as a collateral failed.
The Federal Property Management Agency did not give permission to put City-Mall up for auction, since it was arrested in the framework of the criminal case.
Now many experts agree that the bankruptcy of the company that manages the mall will allow Alfa-Bank to remove the arrest from the seized assets of Pavlov. The ability to repay at least part of the debt as a collateral lender is the most rational option in such a situation. Another thing is that in order to solve this problem, the bank still has to apply to the court and the investigation with numerous petitions.
