THE ARBITRATION MANAGER DEMANDS 529 MILLION RUBLES FROM HIS PREDECESSOR

Mikhail Kravchenko, who performed the duties of the bankruptcy trustee in the Kubanstroyproject case in 2019-2021, may be brought to financial responsibility. The current arbitration manager in the same case, Pavel Churakov, who took up his duties at the end of last year, demands 529 million from him. The relevant information was published on the website of "Fedresurs" (EFRSB).

According to Churakov, Kravchenko still does not give accounting documents, seals and stamps. At the same time, the predecessor violated the norms of the insolvency law, incorrectly distributed the proceeds received during the bidding period. The bidding itself was also carried out improperly.

Recall that the firm "Kubanstroyproekt", which worked in the field of architecture, began to go bankrupt in April 2018. It was then, according to the claim of the Krasnodar Vodokanal organization, the regional arbitration introduced a monitoring procedure at the enterprise. When applying, it was indicated that the company had a debt to the plaintiff in the amount of 21.8 million. 

In the process, it turned out that the company's debts to creditors reached 1.2 billion. At the same time, the Kuban Universal Bank, which had already been declared insolvent, turned out to be the largest of the creditors.

In April 2019, the company received the status of bankrupt. Mikhail Kravchenko soon became the bankruptcy trustee. And already at the beginning of 2020, he sent statements to law enforcement agencies (the Krasnodar Department of Internal Affairs, the regional prosecutor's office, the Krasnodar FSB), the court and the regional department of Rosreestr, in which he pointed out the signs of premeditation of bankruptcy revealed in the organization.

Kravchenko found that the management of the company, which concluded transactions of dubious content during its work, caused damage to the organization by 2.3 billion rubles. So, if at the end of March the assets of the enterprise amounted to 1.25 billion, then after a while their value decreased to 894.5 million. 

126 transactions were found that had to be invalidated through the court.

Now Mikhail Kravchenko himself may be brought to subsidiary responsibility. The grounds for this in Pavel Churakov's statement are called improperly conducted auctions. It is known that they previously had the right to lease 11 plots of land with an area of 87.6 thousand square meters. meters, various movable and immovable property. The bulk of the firm's assets were pledged to credit institutions.
