The company "Grandtrast-NN" continues litigation in arbitration courts with representatives of the Federal Tax Service. The company is the legal successor of the Nizhny Novgorod trading company, which owned city car dealerships and markets. However, the name change did not help the organization to win a lawsuit in court from the IFNS No. 18, which added a fine and arrears of 720 million. Nizhny Novgorod arbitration recently resumed the previously suspended insolvency proceedings.
The lawsuits of the car dealer and the Federal Tax Service began in 2018. The Federal Tax Service conducted an on-site inspection of the company's activities for 2016-2018. It resulted in fines for trying to circumvent the law. The car dealer used a one-day company for this (Omega LLC), concluding fictitious contracts with it. The organization was fined, additionally adding tax requirements.
The then head of the organization, Vadim Smirnov, left the Russian Federation in 2018, leaving for Spain. The company had to pay 511 million rubles to the budget. The founders even thought about the possible liquidation of the business, but in the end decided to keep it. Alexander Ustavshchikov, well-known in the professional legal community, became the head of the firm.
Now, according to the head of Grandtrast-NN, the company has an opportunity to avoid insolvency. The fact is that the Kanavinsky District Court made a decision on the Verus Group case, which entered into legal force.
In 2017, the company acquired various properties from a car dealer for 3 billion rubles.
The 2017 contract assumed that the company would buy the car dealer's assets, paying their cost in 2020. The purpose of the transaction, as it turns out during the trial, was the embezzlement of 457 million from the budget due to VAT refund. For this, the head of Verus Group, Vasily Remizov, was sentenced to five years, and the deal itself was recognized as fictitious.
According to the director of Grandtrast-NN, now car dealerships, markets, car washes and other real estate should return to the ownership of the organization. And since the claims of the Federal Tax Service appeared precisely in connection with the transaction, which was canceled by the court, there are no grounds to bankrupt the company. Whether the tax service will agree with this will become clear on August 11. An arbitration hearing on the bankruptcy case of the organization is scheduled for this day.
