A resident of a small village located in the Ukhta district of the Komi Republic turned out to be the main creditor in the insolvency case of the medical center "Perfection" of the Kirov region. The organization's debt to an elderly woman amounted to 23 million rubles. At the same time, the only income of the creditor was only a pension.

The bankruptcy claim was recently accepted by the arbitration of the Kirov region. It turned out that the medical organization took several loans from the woman.

The first transaction was made in the amount of 17 million rubles. The amount of the second loan was calculated in foreign currency and amounted to $ 53 thousand.

The medical center was in no hurry to return the funds on time. As a result, the pensioner was forced to apply to the Kirov District Court for protection of her interests. The verdict of the court obliged the organization to pay off the woman, including costs in court and interest on transactions. But even after that, the funds were never transferred.

The medical center, in turn, tried to appeal the decision of the district court. However, neither the Kirov Regional Court nor the Sixth Cassation Court found any grounds for this. The verdict remained unequivocal: the organization must repay its debts to the creditor.

Representatives of "Perfection" tried in court to prove the insolvency of the pensioner's financial claims. It turned out that two businesswomen who acted as guarantors under the concluded contracts did not formalize their obligations in writing.

The financial manager of one of the guarantors indicated that the pensioner could not in any way provide the organization with such a large sum. 

The terms of the loans, which did not involve collateral and interest payments, also looked suspicious from the point of view of the participants in the process. As another argument, the affiliation of the creditor to the debtor was pointed out.

However, the arbitration, where the woman eventually applied, supported the claims of the elderly creditor. The medical center was sent under observation. The amount of 23 million rubles was included in the register of requirements. The hearing of the case will continue in 2023.
