SINGER GLUCK'OZA AGAIN FOUND NO SUPPORT IN THE APPEAL
The appeal of Natalia Chistyakova-Ionova (known under the stage name Gluck'oza), Alexander Chistyakov and Sergey Lubinetsky with a complaint to the Ninth Arbitration Court of Appeal against the June verdict of the Metropolitan Arbitration Court, which recovered more than 26.43 million rubles from the couple and the CEO of the Sistema-A company under subsidiary liability, did not bring results. On November 15, 2022, the appeal was rejected (case no. A40-290933/19).

Earlier, Gluck'oza turned out to be a subsidiary defendant in the bankruptcy case of the Sistema-A film studio (until a certain time, the company was called Glucose Production). Together with her, the arbitration brought to financial responsibility her husband Alexander Chistyakov, who heads the board of directors of NK Ruspetro, and the general director of the organization Sergey Lubinetsky.

The defendants owed 19.3 million rubles to the company "Unwrap" (shop of unusual gifts). The organization owes even more than 7.1 million to individual entrepreneur Galina Zherzdeva.

The company was declared bankrupt back in 2017 (case no. A40-12551/2017). However, in 2019, the insolvency process was stopped, as there were no financial assets left to continue it. The company did not manage to pay off all creditors. As a result, one of the creditors (the company "Our Cinema") appealed to the court with a separate application, demanding that the founders and the management of the film studio be held vicariously liable.

It turned out that the film studio received 50 million rubles from the Cinema Fund to finance the rental of the animated film "Savva. The heart of a warrior." The main part of the tranche (47 million) was intended for the organization of an advertising campaign organized by Our Cinema. However, the counterparty received only 15 million, and the rest of the money went to the accounts of the singer's spouse.

At the end of 2020, the persons controlling the debtor (the Chistyakovs and Lubinetsky couple) were brought to subsidiary responsibility. The appeal filed in May 2021 upheld the court verdict. And the cassation in August 2021 canceled the acts of the previous courts, instructing to review the case anew. In June 2022, the Moscow arbitration court again ordered the defendants to pay 26 million rubles.
