ECOMTECH COMPANY WILL BANKRUPT A MANUFACTURER OF WASTE RECYCLING EQUIPMENT
On October 3, 2022, the Moscow arbitration court received a claim for bankruptcy of the company "Husmann Rus", which produces equipment for complex waste processing. The initiator of the bankruptcy was the company "Ecomtech" (TIN 5036163590), with which the company has long-standing litigation. The claim has not yet been accepted by the arbitration court for consideration.

The company "Husmann Rus" (INN 5003096050) has been operating on the market for more than a decade. According to information from open sources, the founders of the company (in equal shares) are Leonid Tymoshenko and Sergey Mayranovsky. The authorized capital of the company is 1 million rubles.

The company owes its name to the German concern Hussman. Production in Russia was originally created precisely as a representative office of a company from Germany. It was planned that the production of high-tech equipment would be localized in the Moscow region, where it was planned to create a separate plant.

The company previously actively participated in public procurement in the amount of over 239 million rubles. The company itself emphasizes that during the period of operation, the company has implemented more than 230 different projects, including the supply of waste sorting complexes in Russia and CIS countries. The company also operates in the market of equipment for the production of recyclable materials and RDF-fuel from the resulting waste.

It is known that with the company "Ecomtech", engaged in the disposal of sorted materials and the maintenance of waste sorting complexes, the company has been conducting litigation in the courts for several years. In 2021, Husmann Rus even applied to arbitration with a demand to declare Ecomtech bankrupt (case no. A41-48674/21).

The reason for the appeal was the decision of the Moscow arbitration court in case No. A40-5658/20, in which the defendant was recognized as having financial obligations in the amount of 47.896 million rubles. However, it did not come to bankruptcy. The representative of the company "Ecomtech" presented to the court payment orders for July-August 2021, indicating the full repayment of debt obligations, the claim was returned to the applicant, and the case was closed.

At the moment, judging by the presence of Ecomtech's statement on the bankruptcy of Husmann Rus, the roles have changed. It can be assumed that the basis for the appeal was the decision of the ASGM dated August 8, 2022 in case No. A40-236552. In it, the court considered the issue of termination of the supply contract concluded by the companies in 2019.

Ecomtech demanded to recover more than 47.3 million rubles from its counterparty. As a result, the contract itself was terminated by the court, and the firm "Husmann Rus" had to pay the plaintiff 44.325 million rubles of debt and 187,321 thousand rubles as a state fee.
