Don Shipbuilding and Ship Repair Plant was declared bankrupt. The Rostov Arbitration Court made a fateful, but quite predictable decision. The devastation of the plant, which ceased economic activity in 2018, actually began in 2016. But this time the tax service took the lead in the insolvency issue.
In February 2021, the local tax authorities (FTS No. 24 for the Rostov region) tried to return to the treasury 3,987,667.50 rubles, which the company owed to the country's budget, including arrears, penalties and fines.
The court appointed Vitaly Cherny as the bankruptcy commissioner, having set the amount of his monthly remuneration at 10 thousand rubles. He will carry out his own financial investigation in order to understand the real reasons for the ruin of the enterprise.
We should recall that the company itself appeared in 2008. It was founded by the "Southern Commercial System" company with an authorized capital of 100 thousand. The initially successful venture began to generate losses in 2012. The company ended 2017 with a loss of RUB 1.2 million. From the provided financial statements, it follows that the company's debt in 2018 amounted to 52 million rubles, having exceeded the real assets of the enterprise by almost 9 million rubles.
Such a quick decision of the court on the company's transition to competitive procedures is explained by the fact that the concept of an “absent debtor”, whose property cannot cover legal costs, was used in the case. In such a case, the application of measures such as supervision, external management or financial recovery is not required by law.
It turned out that the head of the plant, Stanislav Sinyavtsev, who was supposed to declare the company’s bankruptcy several years ago, was also absent, and the attempts of the Federal Tax Service to bring him to administrative responsibility (part 5 of article 14.13 of the Administrative Code) have not brought any success. The last tax declaration was submitted by him over a year ago.
Whether it is worth waiting for salary payments to those 40 employees who once worked at the plant is not clear. Usually, salary debts are paid off precisely during the competitive procedures, when the company's property is sold. The company owns vehicles.
According to materials of the court, the plant has non-current assets in the amount of 514 thousand rubles, reserves for 38.3 million rubles and other assets for 4.5 million. Olga Gorbatenko is considered the main beneficiary of the company.
