CREDITORS OF "DUCK FARMS" SPEND UP TO 1 MILLION MONTHLY DUE TO INTERIM MEASURES
"Duck farms" (TIN 7453266770) went bankrupt in February 2019 (case no.A76-5451/2017). As part of the bankruptcy proceedings, the property complex of the enterprise was put up for auction, which was sold for 312.6 million rubles from the sixth time. The buyer of the lot was entrepreneur Kurbanjon Jamolov, who grows grain in one of the rural areas of the Chelyabinsk region.

The contract with him (No. 75513) was signed on March 14, 2023. However, the deal did not suit one of the structures of the agricultural holding "Ravis" – breeding stud farm (PKZ "Dubrovsky"). The company insisted on the pre-emptive right to acquire the asset, taking into account the land property bordering the territory of the "Duck Farms". A similar right was claimed by the Lipetsk company "Chicken Kingdom" (JSC), part of the Cherkizovo Group of Companies.

"Dubrovsky" appealed to the court with a statement demanding to take interim measures. In support of the petition, it was reported that Jamolov allegedly concluded a lease agreement with the bankruptcy trustee Sergei Sidorov for the production complex and is setting up equipment for laying eggs in incubators. The information was reported with reference to representatives of poultry companies in the region.

On September 12, the Chelyabinsk arbitration granted the petition of the breeding stud farm, forbidding the Bankruptcy Trustee, the buyer of the property complex and other persons to operate the production. Only actions to ensure the safety of property are not prohibited.

According to Sidorov, quoted by Kommersant-South Ural, he did not conclude any lease contracts with Jamolov or other persons. At the same time, the deal was approved by the creditors' committee back in July 2023.

At the moment, creditors are forced to bear the costs associated with the payment of utilities, the protection of the enterprise. Their amount reaches 1 million rubles a month, says Kommersant. The removal of interim measures would allow creditors to "throw off" the financial burden, but the bankruptcy trustee does not really hope for success in appealing the court verdict.

Now there are 73 claims in the register of creditors of Duck Farms. The total amount of liabilities is 1.23 billion. The main collateral creditor of the company, controlling 99.99% of the authorized capital, was originally the Rosselkhoznadzor. His claims amounted to 756.5 million. In February 2021, the rights were transferred to Investstroy as a cession, and in January 2023, he ceded them to Polyus and private entrepreneurs Gulzara Askerova and Eleonora Aritkulova.
