A LARGE MANUFACTURER OF SWEETS FROM SAMARA HAS BEEN DECLARED BANKRUPT
On September 25, 2024, the Samara arbitration court decided on the bankruptcy case of the once largest "candy" enterprise in the region (case No. A55-38923/2022). The Samara Confectioner company (CJSC) was declared insolvent. The court approved Evgenia Manoylova, representing the Association of the Krasnodar Interregional Self-regulatory Organization of Arbitration Managers "Unity", for the role of bankruptcy trustee.
The company appeared in the capital of the region in 2000. In 2011-2021, the company's revenue ranged from 446 million to 1.2 billion rubles. In the region, the company was known among consumers by the trademarks "Rio Rio", "Volga Dawns", "Samara Bird" and many others. Until 2022, Vladislav Konovalov was the sole beneficiary of the company. Then the ownership and management of the enterprise passed to Tamara Lapukhova.
In 2022, the tax authority appealed to arbitration, demanding that the company be declared bankrupt. The reason for the claim was the non-payment of mandatory payments and a debt in the amount of more than 180 million rubles.
In December 2022, the court accepted the case for consideration, but in August 2023 it was suspended until the cassation in another case (No. A55-26316/2022) was considered. In it, the firm tried to challenge the accrual of additional tax payments. However, this could not be done. At the end of 2023, the bankruptcy process was resumed.
During the legal proceedings, a representative of the company applied for a postponement of the court hearings, since the company intends to conclude a settlement agreement with creditors. But the arguments of the "Samara pastry chef" did not suit the representatives of the Federal Tax Service. According to the fiscal officers, by this time the company did not have the necessary assets to settle debts and the signing of a settlement agreement in the tax department was considered inappropriate.
To date, in addition to the regional Federal Tax Service, other enterprises with claims for 308 thousand (the company "SELL-Service") and 585 thousand (the company "ITECO Russia") appear in the register of creditors of the company. Some of them have not been included in the registry yet. The bankrupt owed 2.2 million rubles to Vitafoods. The trading company "Partner" demands 1.5 million rubles from the defendant. The total amount of financial claims against the organization is more than 361 million.
