A NUMBER OF BANKRUPTCY CASES IS GROWING IN KAMCHATKA

The Kamchatka Krai has shown an increase in the number of bankruptcies among citizens by 68% since January 2020. The source of statistical data was the regional department of Rosreestr. It turned out that 168 people were involved in the insolvency procedures at the beginning of September. However, the number of bankrupts may continue to grow, given the changes in legislation that have occurred on September 1.



The fact is that the amendments to the special law on insolvency, allowing the citizens to become bankrupt, bypassing the court instance, have come into effect in Russia. We are talking about those persons whose debt ranges from 50 to 500 thousand rubles. In this case, you can submit an application and go through three possible procedures: restructure debts, sell property, or go to an amicable agreement with the creditor.

Offices of the MFC in Kamchatka have already opened their doors to citizens planning to go bankrupt at their place of residence or place of stay on September 1.

It is known that the procedural part of the issue related to the application form and the procedure for filling it out is regulated in detail by the relevant Order of the Ministry of Economic Development of Russia (No. 497 of 08/04/2020).

At the same time, lawyers remind that independent bankruptcy of citizens also has negative consequences. A person is actually limited in his or her ability to make transactions for opening / closing bank accounts, since the insolvency officer will do this on his or her behalf.

Difficulties can arise in case of a desire to travel abroad, since such a travel may also be restricted by the court.

What is more, the citizen will be required to report any attempt to take out a bank loan for five years after bankruptcy. At the same time, it will no longer be possible to bankrupt yourself again in the same period.
