THE COURT BANNED THE EX-CHAIRMAN OF THE SUPERVISORY BOARD OF MFBANK FROM LEAVING THE RUSSIAN FEDERATION
The appeal (the Ninth Arbitration Court of Appeal) satisfied the complaint of the International Stock Bank (MFBank) represented by the Deposit Insurance Agency. The court issued a ban against the former top manager of the bank, Yevgeny Usoltsev, forbidding him to travel abroad. The court's decision will be relevant until the sale of assets is completed or the insolvency case is closed.

Earlier, the Moscow Arbitration Court (the Arbitration Court of the city of Moscow) adopted a judicial act, which refused to restrict Usoltsev's movement outside the Russian territory. By this verdict, issued in August 2024, the application of the Deposit Insurance Agency was denied. The agency submitted the application itself on May 17, justifying its claims with serious risks to the fulfillment of the debtor's obligations to creditors.

This time, the Ninth Arbitration Court of Appeal pointed out that Usoltsev's actions, carried out jointly with other bank managers, caused significant damage to the credit institution. The case file notes that the former head of the supervisory Board participated in the approval and signing of bad loan agreements. This led to the loss of a significant part of MFBANK's assets. At the same time, the damage caused to the organization has not been reimbursed.

The appeal stressed that in the case of Usoltsev's departure abroad, there may be risks of concealment or alienation of assets. This will deprive creditors of any opportunity to achieve satisfaction of the stated claims. The travel ban, according to the court, is a necessary measure to protect the interests of creditors.

Recall that on February 20, 2024, the Arbitration Court of the city of Moscow considered the claim of the Deposit Insurance Agency for the insolvency of the ex-chairman of the supervisory Board. Debt restructuring was introduced in relation to Usoltsev. MFBANK's claims in the amount of about 2.2 billion rubles were included in the register of its creditors. In October, Usoltsev officially received the status of bankrupt.

The bank itself lost its license seven years ago. In October 2017, the regulator made a corresponding decision, and by the end of the same year, MFBank was declared insolvent. By that time, he was ranked 316th in the rating of financial organizations of the Russian Federation in terms of the amount of available assets. The bankruptcy management procedure was entrusted to the Deposit Insurance Agency.
