TAX AUTHORITIES HAVE TAKEN CONTROL OF THE BANKRUPTCY OF THE TREKHSOSENSKY BREWERY
The tax authorities managed to get their claims in the amount of 9.65 billion rubles included in the register of the bankrupt enterprise. Employees of the Federal Tax Service (FTS) have been conducting litigation on this issue since October 2019. In January, the arbitration finally sided with the Federal Tax Service, recognizing the results of the tax audit. This means that now over 99% of all creditors' claims against the organization are under fiscal control.

The Trekhsosensky plant has been in bankruptcy since 2019 (case no.A55-31685/2019). The brewery, whose history dates back to the 19th century, was one of the largest in Russia, occupying a leading position in terms of tax payments to the regional budget. The organization is part of the holding of ex-deputy of the Ulyanovsk Legislative Assembly Mikhail Rodionov.

In October 2019, the owner initiated the bankruptcy process. At the beginning of 2020, the company was put under surveillance, and in October 2022 it was declared insolvent. The tax authorities insisted that the company was used in a scheme to illegally conceal revenue. The audit showed that the company was reducing the real volume of recorded beer turnover, artificially underestimating the tax base.

According to data for 2022, the company's revenue amounted to 36 billion. The company earned 142 million in net profit. At the same time, according to experts, the company's debt to creditors amounted to over 19 billion. Experts estimate the property complex of the plant itself at 3.5 billion. However, the auction for its sale has not yet been held.

In February 2023, Rusbankrot announced the inclusion in the register of creditors of the plant's obligations to the German company KHS GmbH, which supplied equipment for the enterprise. Despite protests from the Federal Tax Service, the court included a debt to a foreign firm in the amount of ˆ 300 thousand (more than 20 million rubles).

According to experts, the litigation for control over the bankruptcy process of the plant continues. In recent months, two companies affiliated with the owner of the plant have filed lawsuits against the company. The company "M-Com" and LLC "Trekhsosensky" are trying to prove the existence of a debt of 3.6 billion arising from current payments. Prior to that, similar 5.5 billion claims from other structures associated with Rodionov were not included in the bankruptcy register.
