On April 22, the arbitration court introduced a monitoring procedure, starting consideration of the claim for insolvency of the Nizhny Novgorod company Algol (case No. A43-6903/2024). The supplier of paints and enamels demanded that the Kingisepp Machine-Building Plant (KMP) from St. Petersburg be declared bankrupt. The plaintiff filed an application with the arbitration of the Nizhny Novgorod region on March 26, 2024.

The litigation between the companies has been going on since 2021. The companies signed several contracts, according to which Algol undertook to supply paint and varnish materials for almost 7.2 million rubles. KMP made a full prepayment for the contracts, but did not receive the goods. As a result, the plant was forced to go to court.

In December 2022, KMP won the trial, collecting 8.9 million rubles from the defendant in two lawsuits. According to the first claim, the money (2.9 million) was eventually received. According to Mashnews, with reference to the factory lawyers, Algol listed them in the second half of 2023. But with the second claim, in which the court ordered the defendant to pay KMP 6 million, a misunderstanding arose.

After the publication of the court decisions, Algol supplied the plant with paint under a contract, which became the basis for the recovery of a large sum. By this time, the plant no longer needed paint. Representatives of the company asked the supplier to take the goods back. The latter agreed on the phone, but did not pick up the paint.

In May 2023, Algol went to court, demanding to recover 2.823 million rubles from the plant. The Nizhny Novgorod company estimated the cost of the goods and the resulting penalty in this amount. KMP, in its recall dated July 2023, informed that the goods are in order, stored in a warehouse and waiting for the moment when the supplier will take it back. However, the attempt to return it to Algol, undertaken by the plant last autumn, was unsuccessful. The Nizhny Novgorod company did not want to accept the goods.

The litigation between the organizations continues. The next hearing in the Algol lawsuit is scheduled for July 9. Representatives of KMP believe that in this way the company is trying to avoid debt repayment, as required by the decision of the Nizhny Novgorod arbitration.
